1. ACCEPTANCE OF TERMS

By accessing our website, using our services, submitting contact forms, or providing your information to Bayside Home Improvement LLC (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service. Bayside Home Improvement LLC provides residential and commercial home improvement services throughout California, including but not limited to:

• General contracting services

• Seismic retrofitting and earthquake safety upgrades
• Solar installation preparation and electrical upgrades
• ADU (Accessory Dwelling Unit) construction
• Energy efficiency improvements
• Construction consultation
• Project estimates and quotes
• Emergency repair services

3. SERVICE AREA AND LICENSING

We are properly licensed and insured to operate throughout California including San Francisco, San Diego, San Jose, and all other California communities. All work performed complies with California building codes and local permit requirements.

4. USE OF OUR SERVICES

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to:

• Provide false or misleading information in contact forms or communications
• Interfere with our business operations or staff
• Use our services for any unlawful or prohibited purpose
• Attempt to gain unauthorized access to our systems or client information
• Submit spam or fraudulent requests through our contact forms

5. CONTACT FORMS AND INFORMATION SUBMISSION

When you submit information through our website forms, social media, or other channels, you represent that:

• All information provided is accurate and truthful
• You have authority to provide the information submitted

6. ESTIMATES AND CONTRACTS

• All estimates are provided free of charge and are valid for 30 days unless otherwise specified

• Changes to approved work may result in additional charges and require written approval
• Building permits and inspections will be obtained as required by California and local regulations

7. PRICING AND PAYMENTS

• Pricing is subject to change based on material costs and project scope
• Payment schedules will be outlined in individual contracts in compliance with California payment laws
• We accept cash, check, and major credit cards
• Late payments may incur additional fees as specified in contracts
• Mechanic’s liens may be filed for unpaid balances in accordance with California Civil Code

8. CALIFORNIA-SPECIFIC PROVISIONS

• All work complies with California Title 24 energy efficiency standards
• We provide required disclosures under California consumer protection laws
• Three-day right of rescission applies to contracts signed in your home per California Civil Code
• We maintain required bonding and insurance as mandated by California State License Board
• Compliance with California prevailing wage laws where applicable
• Lead-safe work practices in accordance with California regulations

9. WARRANTIES AND GUARANTEES

• We provide warranties on workmanship as specified in individual contracts
• Material warranties are provided by manufacturers
• All warranties comply with California consumer protection standards including Song-Beverly Act
• Seismic and structural work warranties meet California safety standards
• Emergency repairs may have limited warranty coverage

10. LIABILITY AND LIMITATIONS

• Our services are provided with professional care and expertise
• We maintain appropriate insurance coverage as required by California law
• Our liability is limited to the cost of services provided under contract
• We are not responsible for delays due to earthquake damage, permit issues, material availability, or circumstances beyond our control
• Property damage will be addressed according to our insurance policies and California law

11. DISPUTE RESOLUTION

Any disputes arising from these Terms or our services will be resolved under California law through:

1. Good faith negotiation between parties
2. Mediation through California dispute resolution services
3. Binding arbitration in Santa Clara County, California
4. Santa Clara County Superior Court if arbitration is unsuccessful

12. GOVERNING LAW

These Terms are governed by California state law and local San Jose ordinances. Any legal proceedings will take place in Santa Clara County, California.

13. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our San Jose website. Continued use of our services constitutes acceptance of modified Terms.

14. SEVERABILITY

If any provision of these Terms is found to be unenforceable under California law, the remainder of the Terms will remain in full force and effect.
